ATV Ordinance
In 2019 Vigo County Commissioners adopted an ordinance which allows ATV’s to operate "over and upon county roads" if the person has a valid driver's license to operate an off-road vehicle and the vehicle is registered with the Indiana Department of Natural Resources.
The county ordinance "is for county roads, it doesn't allow (use of off-road vehicles) on any city road." Penalties, upon conviction, include a minimum fine of $100 and a maximum fine of $2,500.
Vigo, like other counties, requires any person who operates an off-road vehicle to have vehicle liability insurance coverage with a minimum of $100,000 per person and $300,000 per occurrence. The ordinance requires a person to carry proof of such insurance at all times when operating an off-road vehicle on county roads.
Some other provisions in ordinance include restrictions on use.
Off-road vehicles cannot be operated on a railroad track or railroad right-of-way, except for railroad personnel in performance of duties. And cannot be operated across a cemetery or burial ground or in a forest nursery, planting area or public land posted as an area for forest or plant reproduction. Such vehicles cannot be operated within 100 feet of a dwelling between midnight and 6 a.m., except on the individual's own property or under the individual's control (such as a lease) or as an invited guest.
Off-road vehicles cannot be operated on county roads one-half hour before sunrise and one-half hour after sunset without displaying a lighted headlight and lighted tail-light, according to the ordinance.
A driver off an off-road vehicle may not cross a county road or enter upon a county road other than at right angles.
